Preamble
The company NAGAD is responsible for operating the online store of the company A.T.H, whose headquarters are located at 31 Quai des Grésillons, 92230 Gennevilliers, France, registered with the Nanterre Trade and Companies Register under number 949097406, VAT number FR14949097406.

NAGAD’s mission notably includes sales activities, order management, and sales promotion.

These general terms and conditions of sale apply to the sales of REDSKINS-branded products on the website managed by NAGAD.

BETWEEN:

The company NAGAD,
a simplified joint-stock company with a capital of €13,000,
registered office in PARIS - 7 rue Papillon - BP No. 50031 75421 Paris 09 PPDC,
registered with the RCS of PARIS under number 522 988 989.

AND

Any individual, of legal age and capacity, non-commercial, residing exclusively in Mainland France, Belgium, Luxembourg, and D.O.M., making a purchase of a product on the website.

For the purposes of these terms, the Client and NAGAD will be collectively referred to as the "Parties" and individually as a "Party."

These terms (hereinafter referred to as the "general terms and conditions of sale") govern the sale of REDSKINS-branded products carried out by NAGAD through the Website.

NAGAD reserves the right to modify these general terms and conditions of sale at any time by publishing a new version on the Website. The applicable general terms and conditions of sale are those in effect on the Website at the time the Client places an order. Any order of a product offered on the Website implies the Client's full and unconditional acceptance of the general terms and conditions of sale in effect at the time of placing the order.

ARTICLE 1: PURPOSE
The purpose of these general terms and conditions of sale is to define the conditions under which products are sold by NAGAD to the Client. They regulate the various steps of the sales process, from order placement to product delivery.

ARTICLE 2: PRODUCTS
The products offered for sale by NAGAD are those displayed on the Website on the day of its consultation, subject to availability.
The product images are for illustrative purposes only; each product also has a detailed description.

NAGAD is committed to delivering products that comply with European regulations concerning safety and consumer health, particularly regarding regulated chemical substances.

Information regarding product availability is provided to the buyer at the time of order placement.

ARTICLE 3: PRICES
Prices are indicated in euros, inclusive of all taxes, excluding delivery charges.

The company reserves the right to modify its prices at any time, but ordered products will be invoiced at the price in effect at the time of order registration.

Delivery charges are communicated to the Client in the order summary before final validation; they are inclusive of all taxes unless stated otherwise in a special offer. These charges are borne by the Client and invoiced in addition to the product prices.

The transfer of risk for loss or damage to the products occurs after delivery and receipt by the Client.

The applicable VAT rate is the one in effect in France on the day of order validation.

ARTICLE 4: ORDER AND PAYMENT

4.1 Order Placement

After creating an account:

  • Step 1: The Client selects the desired products.
  • Step 2: The Client reviews the shopping cart and may modify the order (product, size, color, quantity).
  • Step 3: The Client confirms the order, enters shipping and billing details, and accepts the general terms and conditions of sale.
  • Step 4: The Client enters payment details.

The Client will then access the secure payment screen of CIC, NAGAD’s partner.

Payment is made online by credit card only, excluding AMERICAN EXPRESS. The Client must enter the credit card number, expiration date, and the three-digit security code on the back of the card.

If the payment is accepted, the Client will be redirected to an order confirmation screen on the Website.

In case of a failed payment attempt, the Client has up to three attempts to re-enter payment details. After the third refusal, the Client will be redirected to a page indicating the payment failure and will be invited to contact NAGAD’s customer service for further assistance.

4.2 Order Confirmation

Once the Client's payment is accepted, they will receive an order confirmation email. This email will summarize all ordered items, the billing and shipping addresses, and will be sent no later than ten (10) business days after order placement.

The Client's validation of the order and NAGAD’s order confirmation email, following payment acceptance, constitute a sales contract between the Parties and acceptance of the general terms and conditions of sale.

The Client can print their invoice by logging into their account and accessing the order tracking section.

NAGAD reserves the right to refuse order validation in cases of:

  • Abnormal or abusive claims,
  • Orders deemed unusual in terms of quantity,
  • Excessive or abnormal returns and exchanges,
  • Manifestly incorrect product pricing,
  • An ongoing dispute with the Client.

NAGAD’s customer service is available for any inquiries regarding orders via email and phone from 9 AM to 5 PM, Monday to Friday. Contact details are available in the client account section and in the FAQ for users without an account.

4.3 Payment

The full price of purchased products is payable upon order placement.

Payment is made online via credit card (Carte Bleue, Visa, Eurocard/Mastercard) at the time of order validation.

If the bank servers are unavailable, NAGAD reserves the right to retry payment authorization at a later time.

In the event of non-payment, incorrect address, or any other issue with the Client’s account, NAGAD may hold the order until the issue is resolved.

If the Client suspects fraudulent card usage, they should contact NAGAD.

All transactions on the Website are secured by NAGAD’s payment partner, CIC Bank, using SSL encryption. Financial data never transits through NAGAD’s system.

ARTICLE 5: DELIVERY
Orders will be delivered with a delivery note within a maximum of twenty (20) business days for Mainland France, Belgium, and Luxembourg from the day after payment confirmation.

If the delivery exceeds seven (7) days beyond the estimated timeframe without force majeure, the Client may request contract cancellation and receive a full refund within fourteen (14) days. Refunds will be processed within 30 business days.

Each shipped order has a tracking code sent by email to allow tracking via the carrier's website.

COVID-19 Info: Logistics and transport services are adapting while ensuring team safety. Delivery times may be extended due to the current situation.

ARTICLE 6: RIGHT OF WITHDRAWAL
The Client has fourteen (14) business days from the date of receipt to return the purchased products without justification or penalties.

For a return to be accepted, products must not have been worn and must be in their original packaging.

If it is an exchange request, indicate "Return for exchange" and specify the desired product on your return slip or invoice.

Please include your invoice or return slip in your package so we can quickly process your refund.

The return fee is €5 and will be deducted from the refunded amount to cover shipping costs, except if the return is due to a non-compliant or defective product.

For international returns:

Choose the reason for your return On the return slip, please indicate the reason for your return. If you wish to exchange a product, check "Return for exchange" and specify the product you wish to receive instead.

Prepare your return To facilitate the processing of your return, make sure to carefully fill out the return slip or include a copy of the invoice with your package. Before returning your order, please notify us by filling out the contact form on our website. This will allow us to process your request faster.

Please include your invoice or return slip in your package so we can quickly process your refund. We strongly recommend that you return your package with tracking.

Attention: You have 14 days to return your order. After this period, you will no longer be eligible for a refund. Items must not have been worn and must be returned in their original packaging.

For international package returns: If a package is returned to us without being collected or in case of refusal of receipt, we reserve the right to deduct the return shipping costs from your refund.

Non-Compliant Returns
Any product return made outside the conditions set forth in these General Terms and Conditions of Sale will be considered non-compliant. In such cases:

The product will be kept in our warehouses for a maximum period of three (3) months from the date of receipt.

During this period, the customer may request the return of the item:

  • Within mainland France: by paying a flat fee of €10 including tax to cover reshipping costs.

  • Outside mainland France: by providing a prepaid return label (UPS).

After this three (3) month period, if no payment or prepaid label is received, the item will be considered abandoned and will become the exclusive property of the company, with no possibility of claim or compensation from the customer.

Refund Policy: Once your item is received by the Returns Department, we will credit your bank account with the amount of the returned item within 30 business days.

The return fee is €5 and will be deducted from the refunded amount to cover shipping costs, except if the return is due to a non-compliant or defective product.

No return will be accepted without following this procedure. The risks and return shipping costs are entirely the responsibility of the customer (except for cases covered by the non-conformity guarantees under Article 7).

Subject to the above conditions, NAGAD will refund the total amount of the order to the Customer (product price and shipping costs) excluding return shipping costs. The Customer’s bank account will be credited with the amount within thirty (30) days from the receipt of the products by NAGAD.

EXCHANGE

Exchanges are available only for orders delivered within mainland France and for an initial purchase amount greater than or equal to €100 including VAT.

For a first exchange meeting these conditions, the reshipping costs of the replacement product are covered by NAGAD via Mondial Relay.

If the exchanged product is returned (second return), a flat logistical contribution will be deducted from the refund, corresponding to two (2) return fees of €5 incl. VAT each, for a total of €10 incl. VAT.

This deduction covers the processing and transport costs related to the exchange and the return of the exchanged product.

All exchanges are subject to compliance with the general return conditions stated in this article (product unworn, unused, complete, and returned in its original packaging).

ARTICLE 7: WARRANTIES

The products supplied by the Seller are covered by legal warranties, at no additional cost, independently of the right of withdrawal, in accordance with legal provisions:

  • The legal warranty of conformity, for defective, damaged, or non-compliant products,

  • The legal warranty against hidden defects arising from material, design, or manufacturing defects that render the delivered products unfit for use.

It is reminded that under the legal warranty of conformity, the Customer:

  • Has two (2) years from the delivery date of the goods to take action against the Seller;

  • Can enforce the legal warranty of conformity independently of any commercial warranty that may cover the Product.

The Customer may choose to invoke the warranty against hidden defects in accordance with Article 1641 of the French Civil Code. In this case, they may opt for either the cancellation of the sale or a price reduction as provided by Article 1644 of the French Civil Code.

To assert their rights, the Customer must return their order to the address indicated on the return label provided in their customer account after making a return request. Products affected by defects must be returned in the condition in which they were received, with all components (accessories, packaging, instructions, etc.), and accompanied by the invoice.

The Customer may download a prepaid return label by following the procedure in Article 6 or contact the Seller via letter or email to obtain a prepaid return label.

If the products are non-compliant or defective, the Customer will be offered:

  • A store credit for the amount of the returned item. OR

  • A refund of the returned item’s price, no later than thirty (30) days from the date the Customer Service department confirms the non-compliance.

Orders paid in part or in full using a voucher or discount will be refunded with a new voucher or discount.

The Seller’s liability cannot be engaged in cases of improper use, professional use, negligence, lack of maintenance by the Customer, normal wear and tear, accident, or force majeure.

ARTICLE 8: PERSONAL DATA

NAGAD collects a certain amount of information necessary for order processing.

These data are necessary for processing the Customer’s order by NAGAD and for communicating brand, site, and promotional offers to the Customer, should they accept it when validating their order and creating their customer account.

The information is strictly confidential and is marked with an asterisk (*) when required by NAGAD and/or its service providers for order management. The site uses Cap Adresse for data entry assistance.

Following any legal authority's injunction or to defend its rights or those of its employees, clients, or any other person, NAGAD may disclose this data to legally authorized entities.

NAGAD is committed to taking all necessary precautions to ensure the security of its files and protect its computer system, preventing the alteration, damage, or unauthorized access of personal customer data.

Personal customer information is sent and stored with the site host, whose details are available in the "Legal Notice" section of the site.

In accordance with the "Data Protection Act" of January 6, 1978, as amended by the law of August 6, 2004, the Customer has the right to access, rectify, modify, and delete data concerning them.

The site is registered with the CNIL under number 1443732.

The Customer may exercise this right by sending a letter to the following address, via our contact form, or by phone at +33 (0)1 76 41 09 28 (Monday to Friday from 9 AM to 5 PM).

The Customer can also modify their personal information from their customer account by logging in with their email and password.

ARTICLE 9: COOKIES

To process the Customer's order and to better understand their needs, NAGAD uses cookies.

A cookie is a file stored on the Customer’s hard drive, allowing recognition upon their visit to the Site.

Cookies store, during the visit, the Customer’s identity (email and password) and shopping cart contents. Once disconnected, this data is retained for thirty (30) days before being permanently deleted.

The Customer may oppose cookie storage by configuring their Internet browser, though this will disable personalized services on the Site.

 

ARTICLE 10: LIMITATION OF LIABILITY

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, particularly regarding technical performance, response times, connections, queries or information transfers, risks of interruptions, risks of contamination by viruses circulating on the network, and generally all risks associated with the use of the Internet network.

Therefore, the company NAGAD shall in no case be held responsible for any direct or indirect damage resulting from improper use or an incident related to the use of the computer, Internet access, maintenance, or malfunction of servers, telephone lines, or any other technical connection. The Client's connection to the Site is under their sole responsibility.

ARTICLE 11: FORCE MAJEURE

NAGAD shall not be held liable for the total or partial non-fulfillment of its obligations under an order placed by the Client if such non-fulfillment is caused by an event constituting force majeure as defined by applicable law.

In such a case, NAGAD will inform the Client of the occurrence of such an event within three (3) business days following its occurrence via email.

If, after one (1) month, the force majeure event persists, the order will be canceled and, if applicable, refunded by NAGAD to the credit card used for the order within a maximum of thirty (30) days.

ARTICLE 12: APPLICABLE LAW - MEDIATION

The general terms and conditions of sale are executed and interpreted in accordance with French law.

In case of disputes, the Client must first contact NAGAD to seek an amicable solution. If no agreement is reached, common law courts shall have exclusive jurisdiction.

Any question or complaint related to the commercialization of products by NAGAD to a Client should be submitted via email through our contact form or by phone at:

In accordance with Article L. 612-1 of the Consumer Code, within one year from the date of their written complaint, the consumer, subject to Article L.152-2 of the Consumer Code, may request an amicable resolution via mediation through SAS Médiation Solution:

Both the Seller and the Client are free to accept or refuse alternative dispute resolution methods, and, in case of mediation, to accept or refuse the solution proposed by the mediator.

The Client always retains the right to bring their case before the competent courts under common law conditions.

ARTICLE 13: INTELLECTUAL PROPERTY RIGHTS

NAGAD owns and holds usage rights over all photos and images on the site. Any reproduction, representation, modification, publication, or adaptation of the site's photos and images, regardless of the means or process used, is prohibited unless prior written authorization is obtained from NAGAD. Any unauthorized use of the site's photos or images will be considered an infringement and prosecuted in accordance with Articles L.335-2 and subsequent provisions of the Intellectual Property Code.
